1. Acceptance of the Terms
These Terms and Conditions of Use (the "Terms") govern access to and use of the website https://www.kumafinances.com, the Kuma Finances mobile application, the artificial intelligence assistant "Ren", and any related feature, content, tool, module, integration, notification, API or service (collectively, the "Services").
The Services are offered by Kuma Finances S.A.S, domiciled in Bogotá, Colombia, legal contact email kuma_admin@kumafinances.com ("Kuma", "we", "us", "our").
By creating an account, accessing or using the Services, you represent that you have read, understood and accepted these Terms and the applicable Privacy Policy. If you do not agree, you must not access or use the Services.
If you use the Services on behalf of a company or other entity, you represent that you have sufficient authority to bind it to these Terms, in which case references to "you" will include that entity.
2. Eligibility and Legal Capacity
The Services are intended for persons who are at least 18 years old or the age of majority applicable in their jurisdiction, whichever is greater. Where local law allows use by minors with authorization, registration and use must take place under the supervision and valid consent of a parent or legal guardian.
You represent that you are not subject to sanctions, regulatory restrictions or legal prohibitions that prevent you from using the Services.
We may refuse, suspend or cancel accounts where there are reasonable indications of a breach of these Terms, fraudulent use, impersonation or legal or commercial risks.
3. Description of the Services
Kuma is a personal finance platform with budgeting features, income and expense tracking, debt tracking, investment tools, expense groups and a conversational AI assistant called Ren. Depending on the plan, the platform may include usage limits, features with a time delay or real-time access to certain modules.
The Services may include free features and paid features, currently marketed as Basic, Pro and Premium. Features, allowances, usage caps, prices, compatibility and availability may change from time to time.
Kuma may offer features based on text, voice, photo, OCR, automated analytics, assistant personality profiles, alerts, educational content, scoring, watchlists, market modules and other informational tools. Some features may be available only in certain territories, platforms or plans.
4. Informational Nature of the Service | No Financial Advice
Kuma is a technology and information tool. Unless expressly and validly stated otherwise in accordance with applicable law, Kuma is not a bank, brokerage firm, broker, custodian, exchange, financial advisor, investment advisor, fiduciary, financial planner, accountant, lawyer or tax advisor.
No information, score, analysis, alert, comparison, response generated by Ren, projection, fair value, target price, categorization, watchlist, investment idea, summarized news item or similar content constitutes a personalized recommendation or an offer or solicitation to buy, sell or hold securities, crypto assets or other financial instruments.
The outputs of Ren and of any automated model are generated on the basis of rules, historical data, statistical models, third-party data and/or artificial intelligence. Those results may be incomplete, erroneous, outdated, biased or unsuitable for your specific situation.
You are solely responsible for evaluating your financial and investment decisions. You should always supplement the information with your own judgment and, where appropriate, with independent and qualified professional advice.
5. Investment, Market and Performance Risks
Financial markets involve risk. The value of assets and investments may rise or fall, and past performance does not guarantee future results.
Kuma does not guarantee returns, capital preservation, accuracy of projections, availability of opportunities or financial results of any kind.
If you decide to use information displayed by Kuma to manage your assets, you do so at your sole risk. Kuma is not liable for portfolio losses, late decisions, timing errors, slippage, taxes, transaction costs, market movements, market closures or unavailability of data providers.
6. User Account and Security
To access certain features, you must create an account and provide complete, truthful and up-to-date information. You are responsible for maintaining the confidentiality of your credentials and for all activities carried out from your account.
You must notify us immediately of any unauthorized access, security compromise or misuse of your account.
You may not share credentials, sell access to your account, circumvent usage limits, create fake or automated accounts without authorization, or use another user's account without permission.
7. User Data, Submitted Content and Licenses
You retain ownership of the information, text, images, files, commands, queries, financial records and other content that you upload to or enter into the Services ("User Content").
By using the Services, you grant us a non-exclusive, worldwide, revocable license, limited to what is necessary, to host, process, transmit, analyze, reformat, display and use User Content solely to operate, maintain, protect and improve the Services, as well as to comply with legal and contractual obligations.
You represent that you have the rights, authorizations and legal bases necessary to upload User Content, including your own financial data or third-party data for which you hold valid authorization.
You must not enter unlawful, defamatory, fraudulent or infringing information, malware, third-party secrets without authorization, or data whose collection or processing violates applicable law.
8. Artificial Intelligence and Automated Processing
Ren and other Kuma features may use proprietary or third-party AI models to interpret text, images, voice and other inputs, as well as to generate summaries, categorizations, responses and suggestions.
AI responses may contain errors, omissions, imprecise language or unintended results. You should not rely exclusively on an automated output to make material decisions.
To the extent permitted by law, we may use queries, feedback and usage metadata in aggregated, anonymized or de-identified form to train, calibrate, evaluate safety, prevent abuse and improve the performance of the Services, unless the Privacy Policy or the product settings provide otherwise.
Where applicable law requires specific consent for automated processing, sensitive data or model training or improvement, Kuma will request such consent separately or disable the corresponding feature until it is obtained.
9. Third-Party Data, Integrations and Accuracy of Information
The Services may depend on external providers, including but not limited to payment gateways, app stores, analytics services, AI models, storage services, market data providers, messaging, OCR, notifications and authentication services.
Kuma does not control or guarantee the accuracy, availability, continuity, security or legality of content or data provided by third parties. Any market data, price, news item, signal, corporate event or indicator may arrive with delays, errors or interruptions.
Use of certain modules may also be subject to the terms and policies of the relevant third parties, for example Apple App Store, Google Play, Telegram and any data provider integrated into the product.
10. Plans, Pricing, Subscriptions and Billing
Kuma may offer one or more free and paid plans. Prices, currency, billing periods, applicable taxes, usage caps and features will be displayed within the site, the app, the paywall or the applicable app store at the time of purchase.
Unless expressly stated otherwise, paid subscriptions are billed in advance for each period and renew automatically for successive periods of equal length until you cancel.
Paid subscriptions are currently available only as in-app purchases through the Apple App Store and Google Play. Billing, renewal, cancellation and refunds are additionally governed by the rules of the store where the purchase was made, as applicable. If a web purchase channel is enabled in the future, it will be announced on these pages and the conditions published there will apply.
You authorize Kuma and/or the applicable payment processor to charge the authorized amounts, taxes and fees to the payment method you selected. If a charge is declined, we may suspend or downgrade access to paid features until payment is received.
We may change prices, benefits or usage limits in the future. Where required by law, we will give reasonable advance notice of changes. The applicable price will be the one displayed at the time of renewal or purchase, subject to the rules of the relevant store or processor.
11. Cancellations, Refunds and Access Period
You may cancel a paid subscription at any time. Cancellation will prevent future automatic charges but does not automatically eliminate or reverse charges already made and, unless mandatory law or an applicable policy provides otherwise, access will continue until the end of the period already paid.
Purchases made through the Apple App Store or Google Play must be managed directly from the user's account in that store and are subject to its cancellation and refund policies.
Kuma cannot process refunds directly for payments made in those stores; any refund request must be submitted to Apple or Google in accordance with their policies. Nevertheless, Kuma may grant credits or courtesies at its sole discretion or where there is an applicable legal obligation. For more details, see the Refund and Cancellation Policy.
Uninstalling the app or merely deleting the account does not necessarily cancel a subscription purchased through a store. The user is responsible for completing the cancellation process in the relevant purchase channel.
12. Acceptable Use and Restrictions
You agree to use the Services lawfully and in accordance with these Terms. In particular, you may not: (i) use the Services for illegal or fraudulent activities; (ii) breach security systems, perform unauthorized scraping or reverse engineering except where mandatory law permits it; (iii) resell, sublicense or commercially exploit the Service without authorization; (iv) interfere with the normal operation of the platform; (v) use unauthorized bots, scripts or automation to circumvent limits; (vi) upload harmful content, malware or prompts intended to compromise security; or (vii) infringe the rights of third parties.
Kuma may monitor, filter, limit or block activity where reasonably necessary to protect the platform, other users or third parties.
13. Intellectual Property
Except for User Content and third-party rights, Kuma and its licensors own all rights to the software, design, trademarks, logos, compilations, interfaces, base prompts, documentation, graphics, databases, selections and arrangements of the Service.
No ownership is transferred to you. Your right is a limited, revocable, non-exclusive, non-sublicensable and non-transferable license to use the Services in accordance with these Terms.
"Kuma", "Ren" and other associated distinctive signs are trademarks or distinctive assets of Kuma or its licensors and may not be used without prior written authorization.
14. Feedback
If you submit suggestions, ideas, comments or improvement proposals about the Services ("Feedback"), we may use them freely for any lawful purpose, without any obligation of confidentiality, compensation or attribution, unless we expressly agree otherwise in writing.
15. Privacy and Data Protection
The processing of personal data is governed by Kuma's Privacy Policy, which is incorporated by reference into these Terms.
You acknowledge that, in order to provide the Services, Kuma may process account data, usage data, device data, financial information you upload, interaction metadata, the content of queries to Ren and other data described in the Privacy Policy.
In the event of a conflict between these Terms and the Privacy Policy regarding the processing of personal data, the Privacy Policy will prevail with respect to such processing, except where the law requires otherwise.
16. Availability, Changes and Beta Features
Kuma may modify, update, interrupt or discontinue all or part of the Services, features, plans, integrations or AI models at any time, with or without prior notice, except where the law requires specific notification.
Some features may be identified as beta, experimental or in testing. Such features may contain errors, change without notice or be withdrawn at any time, and are offered "as is".
17. Suspension and Termination
We may suspend, limit or terminate your access immediately if: (i) you breach these Terms; (ii) there is a risk of fraud, abuse or harm to third parties; (iii) there is a legal or regulatory requirement; (iv) there is non-payment; or (v) maintaining your account represents a security or compliance risk.
You may stop using the Services at any time and request the deletion of your account in accordance with the Privacy Policy and the available functionality.
Termination does not extinguish outstanding obligations, including accrued payments, licenses already granted for the operation of the Service, disclaimers of warranties, limitations of liability and provisions that by their nature should survive.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without express, implied or statutory warranties of any kind, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, compatibility or expected results.
Kuma does not warrant that the Services will be uninterrupted, error-free, completely secure or suitable for your particular objectives, or that any errors will be corrected.
19. Limitation of Liability
To the maximum extent permitted by law, Kuma, its affiliates, officers, employees, contractors, licensors and suppliers will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, or for lost profits, loss of data, loss of opportunity, loss of investments, loss of goodwill or business interruption arising from the use of or inability to use the Services.
To the maximum extent permitted by law, Kuma's total aggregate liability for any claim related to the Services will not exceed the amount actually paid by you to Kuma for the Services during the twelve (12) months preceding the event giving rise to the claim, or USD 100 if you made no payments, except to the extent that mandatory law provides another minimum or prohibits such limitation.
Nothing in these Terms excludes or limits liability that cannot be validly excluded by law, including, where applicable, willful misconduct, fraud or injury caused by gross negligence where the law so provides.
20. Indemnification
You agree to defend, indemnify and hold harmless Kuma and its affiliates, officers, employees and suppliers from and against any claims, damages, losses, liabilities and expenses (including reasonable attorneys' fees) arising from: (i) your use of the Services; (ii) your User Content; (iii) your breach of these Terms; or (iv) your violation of third-party rights or applicable law.
21. Electronic Communications
You agree to receive electronic communications related to your account, the Service, security, billing, renewals, changes to the Terms, support and marketing, to the extent permitted by law and in accordance with your preferences or applicable consent.
You are responsible for keeping your email address and other contact details up to date.
22. Governing Law and Dispute Resolution
These Terms are governed by the laws of Colombia and LATAM, without prejudice to the mandatory consumer protection rules applicable in the user's place of residence where they apply.
Any dispute arising from these Terms or the Services will be resolved before the competent courts of Colombia, in the Spanish language, unless applicable law grants the consumer the right to bring the matter before another forum.
23. Changes to the Terms
We may modify these Terms from time to time. The current version will be published with its last update date.
Where a change is material, we may notify you by email, within the Service or by other reasonable means. Continued use of the Services after the changes take effect will constitute acceptance, except where the law requires additional consent.
24. Assignment, Severability and Entire Agreement
You may not assign these Terms or your rights or obligations without our prior written consent. Kuma may assign them in the event of a corporate reorganization, merger, sale of assets or change of control.
If any provision is held to be invalid or unenforceable, this will not affect the validity of the remaining Terms, which will remain in full force and effect.
These Terms, together with the Privacy Policy and any additional terms validly incorporated, constitute the entire agreement between you and Kuma regarding the use of the Services.
